The bikes supplied by Quiet Rush are classified as a Power Assisted Pedal Cycle and are subject to a maximum power output not exceeding 250 watts and a maximum assisted speed of 25km/h for use in public areas. Riding beyond that speed in public areas is only possible through rider effort. In unrestricted form, they constitute an off road vehicle only, and cannot be ridden legally in public areas. If the purchaser or any person known or unknown to them does so, they engage in this activity entirely at their own risk. Further information regarding eBike regulations in Australia can be found at http://www.minister.infrastructure.gov.au/ck/releases/2012/May/CK013_2012.aspx, noting that there are significant variations in the international regulations that apply to ebikes, evident in http://en.wikipedia.org/wiki/Electric_bicycle_laws. The bikes are manufactured to be export suitable to an international market.
We are not responsible for any personal injuries or property damage allegedly resulting from products sold through any of our channels of business. Users should use their best judgment when purchasing a product and exercise their discretion when using these bikes, taking into account the riders skill, bike condition, prevailing conditions and laws that apply within the areas in which they are operated. Use of our products is completely at your own risk. Please contact us immediately in the event of any injuries or property damage resulting from product malfunction so we can liaise with the manufacturer. If the injuries or property damage have arisen from improper or illegal usage, the liability and consequences associated reside with you as the owner/operator of the bike.

Warranty
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our Stealth Electric Bikes come with a frame and swing arm lifetime warranty, whilst all other components have a 1 year warranty against defective workmanship. The warranty period commences from the date that Quiet Rush receive final payment for your order.
Payments and processing of invoices
Quiet Rush P/L has the sole discretion to provide the terms of payment. Unless otherwise agreed, payment must first be received by Quiet Rush P/L prior to formal acceptance of an order. Unless an alternate credit term has been agreed upon, payment for the products shall be made by credit card, paypal, Electronic Fund Transfers or BPay.
Invoices are due and payable within the time period noted on your invoice, measured from the date of the invoice. An order may be invoiced separately. Quiet Rush P/L has all the discretion to cancel or deny orders. Quiet Rush P/L is not responsible for pricing, typographical, or other errors in any offer by Quiet Rush P/L and reserves the right to cancel any orders arising from such errors. Invoices must be paid within 15 days of the invoice date. For all but consumer purchases, Quiet Rush P/L reserves the right to charge you a late penalty charge of 1% per month applied against undisputed overdue amounts or the maximum rate permitted by law whichever is less. Every 30 days thereafter, you will continue to be charged an additional late penalty charge.
You represent and warrant that if you are purchasing something from us or from Merchants that:
(i) any credit information you supply is true and complete,
(ii) charges incurred by you will be honored by your credit card company, and
(iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes and credit card merchant fees that may apply.
Refund Policy
All sales are final. Once the order is placed, the bike will be scheduled for delivery to an address nominated by you. No refunds will be offered, but in the event that you are unsatisfied with your Stealth bike, we have a ready list of people who are seeking one and can facilitate onwards sales if required, or leave that entirely to your discretion. An account manager will contact you to clarify your order and agree any customisations required, at which time upgrade options can be added to the order. At that time any questions or concerns can be answered.
Delivery
On receipt of Final Payment, each Stealth bike is delivered in a secured wooden crate, shipped by road transport, with some minor final assembly required to fit the pedals, handlebar and front wheel - an example of this is provided in our gallery. Shipping times can vary but we work to ensure you have the bike within 2-5 business days ex-Factory door (within Australia) The crates can be heavy, requiring either a two person lift or a forklift for minimising manual handling risks to the shipping company staff. If shipping direct to you is your preferred delivery, please take this into consideration. Alternately, you may prefer to pick up your bike direct from the factory to eliminate shipping costs. These are aspects that will be discussed during the finalisation of your order.
